How do you choose the right UAE business activity and licence?
Choose a UAE business activity, licence, authority and legal form by testing what the company sells, where it operates and which approvals apply.

Overview
Start with the transactions the company will actually perform, not the label that sounds closest. The activity affects the licensing authority, licence family, legal form, premises, external approvals, banking file and sometimes the available tax analysis. A licence can contain several activities, but every selected activity still needs to fit the operating model and the authority’s current catalogue.
The Ministry of Economy & Tourism’s current formation route states that the nature of the economic activity determines the licence type and that the legal form must be compatible with the activity. It also distinguishes more than 2,000 mainland activities and identifies sectors requiring additional government approval. Free zones maintain their own activity lists and conditions.
Describe the business before searching a catalogue
A useful activity description answers six questions:
- What does the customer buy: goods, access, advice, development, intermediation, management or a regulated service?
- Who supplies the result: the UAE company, a foreign group company, a platform user or a subcontractor?
- Where are the customer, staff, stock, equipment and contracting entity?
- Does the company take possession of goods, client money, personal data or regulated assets?
- Does it make claims or decisions in finance, health, education, legal services, transport or another supervised field?
- Does it need a shop, office, warehouse, workshop, clinic or only an administrative workspace?
The same product can produce different answers. A software company licensing its own SaaS, developing software for clients, operating a marketplace and reselling third-party hardware may need several activities rather than one broad “technology” label.
Licence family is only the first classification
The Ministry lists commercial, professional, industrial, tourism, agricultural and occupational/craft licence families for mainland formation. A family does not select the precise activity. “Commercial” may cover different trading models; “professional” does not automatically authorise every advisory service; manufacturing and warehousing can add premises and authority requirements.

Mainland and free-zone catalogues are not interchangeable
A mainland authority and a free zone may use similar words but attach different permissions and conditions. The decision should test:
- where contracts are performed and customers are served;
- whether goods enter the UAE and where they are stored;
- whether the company needs a physical customer-facing location;
- whether the free zone accepts the activity combination;
- whether work outside the zone requires another route;
- whether a sector regulator must approve owners, managers, premises or products.

External approval can be the real licence gate
The Ministry’s official route lists examples of additional approvals for transport, legal services, engineering, telecommunications, tourism, insurance, health and oil-and-gas activities. The list is illustrative, not a universal clearance table.
Initial approval means the authority has no initial objection to formation; the official route expressly says it does not authorise the investor to start conducting activity. Before filing, identify the full authority chain and the order in which approvals, premises and professional qualifications are required.
Test the activity against banking and tax evidence
The licence description should agree with the website, contracts, invoices, suppliers and expected bank flows. A narrow consultancy activity paired with trading flows creates a KYC inconsistency. A general label selected only because it was cheap can be equally difficult to explain.
Activity selection also does not determine a tax result by itself. Corporate-tax and VAT treatment follows the applicable tax law and actual transactions. A free-zone licence alone does not establish that all income qualifies for a preferential treatment.
Activity-selection worksheet
For every revenue line record:
- customer and country;
- exact deliverable;
- contracting and invoicing entity;
- delivery channel;
- goods, money, data or assets handled;
- staff and premises required;
- third parties used;
- candidate authority/activity;
- external approval and evidence;
- unresolved question.
The worksheet should return candidate routes, not fabricate a definitive code. The final activity wording is checked in the chosen authority’s current catalogue before reservation or filing.
Changing or adding an activity later
An amendment can affect the licence, constitutional documents, premises, external approvals, immigration allocation, bank KYC and tax profile. Before launching a new product, compare the existing licence with the new revenue line and update connected records in the correct order.

Frequently asked questions
Can one UAE licence include several activities?
Yes, the Ministry’s formation route says a licence may include more than one activity. The authority still decides whether the proposed combination is available and what conditions or fees apply.
Is the cheapest activity the best choice?
Not necessarily. A low-cost activity that does not match contracts, staff, premises or bank flows can create amendment costs and onboarding delays.
Does initial approval allow the company to trade?
No. The official mainland route states that initial approval is not permission to start conducting activity.
Is a consultancy licence enough for SaaS?
It depends on what the company actually supplies. Custom development, software licensing, platform intermediation and technology advice are different operating models.
Does a free-zone activity work across the UAE automatically?
No universal answer applies. Check the zone rules, the way the activity is performed outside the zone and any mainland or sector approval requirement.
Can the activity be changed after incorporation?
Usually an amendment route exists, but approval, documents, premises, bank and tax records may also need changes.
