We settled on Georgia, where the client already has a distributor and sales. To confirm commercial activity in Georgia, we provided a license agreement for another client’s trademark, already registered in Georgia.

What was done

The complexity of the project was that the imitation concerned the color scheme and composition of the packaging, and traditional trademarks would not provide sufficient protection. We developed a step-by-step registration strategy, including the registration of traditional trademarks, the registration of simplified versions of marks, and the registration of a non-standard color/composition trademark. This approach allowed us to rely on previously registered trademarks, which simplified the registration of the most complex and controversial mark from the point of view of the national patent office.

In addition, we prepared an individual list of goods and services, which serves as a basis for negotiations with the owner of a similar trademark.

Result

As part of the negotiations, we received consent to register the client's trademark from the owner of a similar mark and signed a coexistence agreement with them, which established mutual guarantees and restrictions on the use of the brand in the UAE market.
